Poland: Evaluation Consultant for Prosecutors and Hate Crimes Training (PAHCT) Programme Implementation in Poland

Background

The Office for Democratic Institutions and Human Rights (ODIHR) is seeking an experienced consultant (hereafter ‘evaluator’) to undertake an objective and independent evaluation of the implementation of the Prosecutors and Hate Crimes Training (PAHCT) programme in Poland.

The evaluation will take place between September 2016 and January 2017. The number of working days envisaged for the assignment – 24.

Prosecutors and Hate Crimes Training Programme:

ODIHR is the principal institution of the OSCE responsible for the human dimension. ODIHR is active throughout the OSCE area in the fields of election observation, democratic development, human rights, tolerance and non-discrimination, and rule of law. ODIHR’s assistance projects and other activities are implemented in participating States in accordance with ODIHR’s mandate.

OSCE participating States have tasked ODIHR to collect and publish data on hate crimes and to identify good practices and responses in addressing hate crimes. ODIHR is also mandated to provide technical assistance to participating States to combat hate crimes.

To this end, ODIHR’s Tolerance and Non-Discrimination Department (TND) has developed and implemented the Prosecutors and Hate Crimes Training (PAHCT) programme, which is designed to increase the effectiveness of prosecutors in investigating and prosecuting hate crimes. The programme achieves this aim through:
•training national prosecutors to become hate crime trainers;
•developing a customized PAHCT course and training materials tailored to the implementing country's hate crime context; and
•cascading the hate crime training to broadest range of prosecutors, with the use of the national trainers and training materials developed.

PAHCT is delivered in close co-operation with a national partner, with whom ODIHR signs a Memorandum of Understanding (MoU). On the MoU's basis, a National Implementation Working Group, consisting of representatives of ODIHR, partner institution and other relevant government bodies and NGOs, is established to advice on the implementation of the programme. The MoU represents the commitment of the participating State as to the scope of implementation and the ways in which the cascading process will be integrated within the existing prosecutorial training structures. While ODIHR leads on the development of the training materials and training of trainers, the partner institution takes over the implementation lead thereafter, being responsible for the cascading of the training to its end users. ODIHR monitors the cascading process and facilitates the evaluation of the programme implementation.

The PAHCT programme implementation is supported by one of the two ODIHR TND's Hate Crime Officers, an Assistant Project Officer, Training Co-ordinator, and external consultants, trained as PAHCT trainers.

Prosecutors and Hate Crimes Training (PAHCT) Programme in Poland:

The Polish authorities requested the implementation of PAHCT in November 2014. Following a needs assessment and data collection phase, in September 2015, ODIHR and the Polish National School of Judiciary and Public Prosecution signed a MoU to implement PAHCT in Poland. Following the establishment of the National Implementation Working Group and customization of the curriculum to local needs, two direct trainings took place in December 2015, and two training-of-trainer sessions took place in March 2016. Training activities at the local level were planned after the training-of-trainers sessions, to start on 29-30 September 2016 and continue thereafter.

OBJECTIVE AND SCOPE OF ASSIGNMENT

The evaluation is intended to assess whether the project meets real and current needs, provide ODIHR with feedback on the design and delivery of the PAHCT programme. The evaluation will seek to understand whether the design is optimally linked to achieving the intended objectives, taking into account external factors that were contributing to or were constraining the delivery of outcomes.

Lessons from the implementation of the PAHCT programme shall be analysed in view of issuing recommendations for enhancing ODIHR’s understanding of how to improve implementation of PAHCT in other countries and how to more efficiently and effectively use resources available for programme implementation. The evaluation will have therefore a backward-looking and a forward-looking dimension.

The evaluation will cover all components of PAHCT programme in Poland, It will include all the relevant activities and steps undertaken between November 2014 (request for implementation), and December 2016 (first cascade trainings delivered, planning for future cascading finalized). The evaluation will also draw on information from an earlier ODIHR programme TAHCLE (Training Against Hate Crimes for Law Enforcement) to better assess the overall foundation and impact.

The evaluation will also consider how the programme design, implementation and delivery took into account needs of women and men and how it impacted them. ODIHR also seeks input on how to better gender mainstream the PAHCT activities going forward.

METHODOLOGY

The evaluation will be based on the 5 DAC criteria as laid out in the DAC Principles for evaluation of Development Assistance (relevance, effectiveness, efficiency, impact and sustainability), but will also include special consideration of the political objectives of the OSCE, the intergovernmental nature of the Organisation, the political and administrative context in which ODIHR operates.

The focus of the evaluation will be on the project beneficiaries, i.e. individuals, groups or entities with which ODIHR has interacted under the auspices of the PAHCT implementation directly or indirectly and whom it can be anticipated that the programme implementation has been able to influence.

A detailed evaluation design will be developed by the evaluator and should make use of a mix of quantitative and qualitative data collection tools: desk review, site visit, interviews, questionnaires, as well as through reviewing other documentation such as financial information from ODIHR systems: IRMA and Doc.IN.

The desk review will mainly include the following type of documents: programme documentation, meeting and training reports, agendas, presentations and training materials.
The site visits envisioned in this evaluation are:
•1 visit to Lublin, Poland: the seat of the partner institution – National School of Judiciary and Public Prosecution. The aim is to observe a 2-day cascade training event, taking place there on 29-30 September 2016. In addition, this visit should be used to interview the partner institution's staff, which was involved in the programme implementation. In addition, further stakeholder interviews are expected to be conducted with the training-of-trainers sessions' participants, and ODIHR's trainers.
•2 visits to Warsaw, Poland: for scoping, and report presentation purposes. The evaluator will conduct interviews with all the relevant ODIHR staff members. In addition, all the bodies represented on the National Implementation Working Group have their seats in Warsaw and should be interviewed during this visit.

A detailed evaluation design and workplan will be developed by the evaluator and agreed with the ODIHR’s Tolerance and Non-Discrimination Department and Project Co-ordination Unit, upon completion of scoping visit to Warsaw.

EVALUATION REPORT

1.The evaluator will submit an evaluation report that will include the following:
•Executive summary that provides a clear, concise presentation of the evaluation’s main conclusions, key recommendations and salient issues identified;
•Description of the methodology used;
•Responses to the evaluation questions (observations, findings, conclusions and recommendations);
•Analysis of lessons learned and good practices.

2.The report shall also contain at least the following annexes:
•List of persons interviewed and sites visited;
•Data collection tools (copies of surveys, questionnaires, etc.);
•A bibliography or list of references;
•The TOR for the evaluation.

Based on the scoping visit, the evaluator will draft specific evaluation questions, which will be agreed with ODIHR’s Tolerance and Non-Discrimination Department management, PAHCT programme staff and the ODIHR Project Co-ordination Unit.

Necessary Qualifications•Advanced university degree (Master’s degree or equivalent) in law, political science, international relations or other relevant disciplines. A combination of relevant academic qualifications and extensive experience may be accepted in lieu of the advanced university degree;

•Extensive experience of designing/implementing and conducting evaluations, in particular of projects implemented at the international level in the human rights field
•Experience in gender mainstreaming projects and programmes ;
•Professional knowledge of English; Polish would be an asset.
•Experience with the OSCE and with the OSCE region would be an advantage.Remuneration PackageRemuneration will be commensurate with the years of experience of applicants. Payment will be made upon receipt of a final evaluation report with a breakdown of the activities carried out and the number of days worked for each of them.
